TERMS AND CONDITIONS AGREEMENT FOR ASBX STORE
PLEASE READ THIS T&C AGREEMENT CAREFULLY BEFORE USING THE ASBX STORE. BY USING THE ASBX STORE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT USE THE ASBX STORE. AND, IF PRESENTED WITH THE OPTION TO “AGREE” OR “DISAGREE” TO THE TERMS, CLICK “DISAGREE”.
These Terms and Conditions of Use (the “Terms of Use”) apply to the ASBX STORE site located at https://asbxstore.com/, and all associated sites linked to https://asbxstore.com/ by ASBX, its subsidiaries and affiliates, including ASBX sites around the world (collectively, the “Site”). The Site is the property of ASBX LDA. (“ASBX”) and its licensors. BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SITE.
ASBX reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use, ASBX grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.
EXCLUSIVE JURISDICTION AGREEMENT
By purchasing goods and services from ASBX LDA, the customer acknowledges and agrees that any and all contracts and transactions are governed exclusively by the laws of Portugal. The customer hereby expressly waives any right to initiate or participate in any legal proceedings against ASBX LDA under any jurisdiction other than the competent courts of Portugal. Furthermore, the customer renounces any claim in any other court, either domestic or international, and acknowledges that the only jurisdiction and venue for disputes arising from or related to the purchase of goods and services from ASBX LDA shall be the courts located in Portugal. The Applicable Language is Portuguese.
If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this Agreement shall continue in full force and effect.
Initial Dispute Resolution. We are available by email at legal@asbx.pt to address any concerns you may have regarding your use of the Services. Most concerns may be quickly resolved in this manner. Each of you and we agree to use best efforts to settle any dispute, claim, question, or disagreement directly through consultation and good faith negotiations which shall be a precondition to either party initiating a lawsuit or arbitration.
Waiver of class or consolidated actions. All claims and disputes must be arbitrated or litigated on an individual basis and not on a class basis. Claims of more than one customer or user cannot be arbitrated or litigated jointly or consolidated with those of any other customer or user.

4. Pricing and Payment
- Prices: Prices are set by ASBX LDA at the time of your purchase.
- Payment Terms: Payment must be made in full at the time of order through the accepted payment methods as specified on the platform.
5. Shipping and Delivery
- Delivery Charges: Delivery charges are calculated based on the delivery address and the type of goods ordered.
- Logistics and Export: ASBX LDA handles all logistics and export activities necessary for the delivery of goods. The risk of loss and title for such items pass to you upon our delivery to the carrier.
6. Returns, Refunds, and Cancellations
- Return Policy: We reinforce that the store is a B2B service and that all products sold via the website are demonstration pieces intended for sampling and are not pieces intended for retail to the final consumer. ASBX does not return, refund or exchange samples purchases made online. Said purchases are merely for approval of quality and fitting towards a possible production development. All private consumers that acquire our samples must do so taking this into full consideration.On Servcices and Virtual Products we do not accept returns or cancelation after the service is completed and provided.
- Refunds: Refunds can only be issued in case of missing or defective goods. Refunds are processed back to the original method of payment within 3 days and only after approval by our team.
- Cancellation: Orders can be cancelled prior to shipment for any reason. Once shipped, is not possible to cancel. .
7. Customer Obligations
- Compliance with Laws: You agree to comply with all applicable laws of Portugal and regulations and the Exclusive Juresdiction Agreement under this contract.
- Accurate Information: You must provide accurate and current information necessary for us to process your order.
8. Dispute Resolution
- Contact: Should you have any disputes or complaints regarding your purchase, please contact ASBX LDA directly to seek a resolution.
9. Changes to Terms ASBX LDA reserves the right to modify these terms and conditions at any time. You are encouraged to review the terms periodically to be aware of such changes.
